Lawyers with Law Enforcement Experience
The concept of lawyers who investigate or ‘investigation counsel,’ is not something new to Canada’s justice system. Regulatory bodies such as the Ontario Securities Commission and the Law Society of Upper Canada have designated lawyers as ‘investigation counsel’ to perform and supervise their investigations. The idea of bringing the Investigation Counsel concept into the market place evolved as a result of discussions between several lawyers with policing experience. At the time, we were all working in downtown Toronto firms and were frequently requested to supervise investigations.
The combining of our criminal, civil, corporate, securities, labour and employment litigation practices with our investigative experience was applied informally to a number of projects. The concept worked well. The result was the formation of the Investigation Counsel Network (ICN) as a professional association of lawyers with policing experience and the Investigation Counsel Professional Corporation (ICPC) as a law firm specializing in fraud litigation, complex investigations and independent counsel services.
